These Terms of Service apply when you purchase a product or service from Qurated Quizzes.

Please read them before placing an order.

1. About us

Qurated Quizzes is operated by Qurated Quizzes Limited, a private company limited by shares incorporated in Scotland under company number SC859829.

Throughout these Terms, “Qurated Quizzes”, “we”, “us” and “our” refer to Qurated Quizzes Limited.

2. Our service

Qurated Quizzes creates personalised quiz experiences using information provided by the customer.

Our current standard product, The Qurated Quiz, consists of three rounds worth 30 points in total and is supplied digitally.

The product description shown on our website at the time you place your order forms part of your contract with us.

Because each quiz is curated individually, the precise mix of questions, subjects, difficulty, humour and personalisation will vary according to the information supplied in your Curation Brief and our editorial judgement.

3. Placing an order

When you place an order through our website, you are making an offer to purchase the product or service described at checkout.

A contract is formed when we accept your order and send you an order confirmation, subject to successful payment.

Please check the information supplied during checkout carefully before placing your order.

Prices are shown in pounds sterling unless otherwise stated. The price payable is the price displayed at checkout when your order is placed.

4. Your Curation Brief

After ordering, you will be asked to complete a Curation Brief.

The Curation Brief provides the information we use to create your quiz, including information about your occasion, guests, preferred subjects, difficulty, humour and any personal details you choose to provide.

Your delivery period does not begin until we receive your completed Curation Brief.

You are responsible for ensuring that the information you provide is accurate and sufficiently complete.

We use the Curation Brief as guidance rather than as an instruction to include every suggestion provided. The final selection and wording of questions remains a matter of Qurated Quizzes’ editorial judgement.

5. Personal information and material you provide

You must only provide information, stories, names, photographs or other material that you are entitled to share with us.

Please avoid providing unnecessary sensitive personal information about yourself or other people.

By providing material for inclusion in your quiz, you give us permission to use that material solely as reasonably necessary to create and deliver your order.

Our handling of personal information is also governed by our Privacy Policy.

6. Starting work on your quiz

Our standard delivery period is within 7 days of receiving your completed Curation Brief, unless we agree otherwise with you.

When submitting your Curation Brief, you will be asked to expressly request that we begin performing the personalised service before the end of the statutory 14-day cancellation period.

Your cancellation rights and the effect of asking us to start work early are explained in our Refund & Cancellation Policy.

If your event is less than 7 days away when you submit your Curation Brief, you should not assume that we can deliver the quiz before your event unless we have expressly agreed to do so.

7. Delivery

Your completed quiz will normally be supplied digitally to the email address associated with your order or otherwise agreed with you.

It is your responsibility to provide a working email address and to check your inbox, including spam or junk folders.

Please contact us promptly if you believe your quiz should have been delivered but has not been received.

8. Changes and corrections

Because the service is personalised, we encourage you to provide accurate and complete information in your Curation Brief before work begins.

If you realise that you have supplied incorrect information, contact us as soon as possible. We will make reasonable efforts to accommodate changes where the stage of production allows.

The standard product does not include unlimited revisions or general change-of-mind rewrites.

However, if we have made a factual error, materially failed to follow the agreed brief, or otherwise failed to provide the service with the standard required by law, your statutory rights are unaffected.

9. Quiz content

We take reasonable care when selecting and preparing quiz questions.

Some quiz subjects can involve matters where information changes over time, where different sources use different conventions, or where an answer may depend on wording or context.

If you identify a potential factual error or ambiguity, please contact us. Where appropriate and reasonably practicable, we will investigate and provide a corrected question or answer.

10. Intellectual property and permitted use

Unless otherwise stated, the design, layout, branding, original wording and other original materials created by Qurated Quizzes remain our intellectual property.

When you purchase a quiz, we grant you permission to use and reproduce reasonable copies of the delivered quiz for the private, family, social, workplace or internal event for which it was purchased.

You must not, without our permission:

• resell the quiz or any substantial part of it;

• publish or distribute it commercially;

• upload it to a quiz database, marketplace or other public repository;

• present our material as a product created for resale by you; or

• remove Qurated Quizzes branding for the purpose of redistributing the product commercially.

Nothing in these Terms claims ownership over facts, ideas or material that belongs to you or to third parties.

11. Cancellation and refunds

Your cancellation and refund rights are set out in our Refund & Cancellation Policy, which forms part of these Terms.

In particular, consumers normally have a 14-day cancellation period for contracts entered into online.

If you expressly ask us to begin work during that period and later cancel after work has begun, you may be required to pay an amount reflecting the work already carried out.

If the service has been fully performed after you expressly requested early performance and acknowledged the consequences for your cancellation right, your right to cancel for a simple change of mind may end.

Nothing in these Terms or our Refund & Cancellation Policy affects your statutory rights.

12. Problems with the service

We will provide our service with reasonable care and skill.

If you believe that your quiz does not conform to what was agreed, contact us as soon as reasonably possible and explain the problem.

Where required by consumer law, remedies may include repeat performance, correction, an appropriate price reduction or refund.

13. Events outside our reasonable control

We are not responsible for a delay or failure caused by circumstances outside our reasonable control.

If something happens that materially affects our ability to deliver your quiz on time, we will contact you as soon as reasonably practicable and explain the position.

This does not affect any rights you may have under consumer law.

14. Our responsibility to you

Nothing in these Terms excludes or limits liability where it would be unlawful for us to do so, including liability for fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded.

If you are purchasing as a consumer, we are not responsible for business losses arising from your use of the service.

We are also not responsible for loss caused directly by inaccurate, incomplete or misleading information supplied by you where we have reasonably relied on that information when creating the quiz.

Your statutory consumer rights are not affected.

15. Privacy

We process personal information in accordance with our Privacy Policy.

Information supplied in your Curation Brief will be used for purposes connected with creating, administering and delivering your order, together with any other purposes explained in our Privacy Policy.

16. Complaints

If something has gone wrong, please contact us first so that we have an opportunity to resolve it.

When contacting us about an order, please include your name, order number and the email address used to place the order where possible.

17. Changes to these Terms

We may update these Terms from time to time.

The Terms applying to your purchase will normally be the version in force when your order was placed. Changes made afterwards will not retrospectively alter an existing contract unless required by law or expressly agreed with you.

18. Governing law

These Terms are governed by Scots law.

If you are a consumer, nothing in this clause deprives you of any mandatory consumer protections that apply to you based on where you live.

19. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
